History Walk Waiver

We hope your history walk (the “History Walk”) experience is safe and rewarding, but accidents can happen. The following waiver must be signed by all participants in order to participate in the History Walk hosted by Friends of the East River Esplanade (60th–120th Streets), Inc. (“Friends of the Esplanade” or “EsplanadeFriends”) on the East River Esplanade Waterfront on May 2, 2026. All participants must be age 18 or older or accompanied by an adult.

I understand that my participation in the History Walk is wholly voluntary and that I am not required to sign this form if I do not intend to participate in the History Walk.

I understand and agree that there may be risks and hazards (“Risks”) associated with my participation in the History Walk, including without limitation, allergic reactions, rashes, transmission or exposure to infectious diseases (including, but not limited to, COVID-19, notwithstanding vaccination and/or booster status); and/or risks involved in interacting with other participants. I understand that this is not a complete list of Risks. I understand and acknowledge that EsplanadeFriends is not an insurer of my health or safety. After a full opportunity for inquiry and investigation as I have deemed appropriate, I knowingly and voluntarily assume any and all risks associated with my participation in the History Walk.

Waiver:

In consideration of being permitted to participate in any way in the History Walk, I, for myself, my heirs, personal representatives, or assigns, do hereby unconditionally release, waive, discharge, and covenant not to sue Friends of the Esplanade or its employees, volunteers, representatives and agents (collectively, the “Related Parties”) from any and all liability, claims, causes of action, costs, expenses, or losses of any kind which arise, directly or indirectly, from my participation in the History Walk, including, but not limited to, any and all injury (including personal injury), illness, disability, or death, or property loss arising from, but not limited to, participation in the History Walk.

Indemnification and Hold Harmless:

I also agree to indemnify and hold harmless the Related Parties from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities—including attorney’s fees—brought as a result of my involvement in the History Walk, and to reimburse the Related Parties for any such costs, expenses, damages, or liability incurred.

Severability:

The undersigned further expressly agrees that the foregoing waiver and assumption of risk agreement is intended to be as broad and inclusive as permitted by the law of the State of New York. If any portion is held invalid, it is agreed that the remainder shall continue in full legal force and effect. Transmission by electronic mail of a PDF document created from the originally signed document or electronically generated signatures (including Docusign) will be acceptable for all purposes.

Photo Release:

I understand and acknowledge that EsplanadeFriends may document the History Walk photographically and/or by other electronic means. I hereby give EsplanadeFriends permission to videotape, photograph, and/or otherwise record, or to hire someone to videotape, photograph or otherwise record, my image or likeness (including, without limitation, my appearance, voice, and name) in connection with my participation in the History Walk. I further consent to EsplanadeFriends’ use in perpetuity of any photographs and/or electronic footage in connection with the History Walk for any and all programs, digital media, web and social media marketing materials, and publications. I hereby release EsplanadeFriends from any and all responsibilities or liability in connection with such aforementioned use.

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS,
understand that I have given up substantial rights by signing it,
and have signed it freely and voluntarily without any inducement or assurance of any nature.
I intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law.
